There are Adjustments to Control Over-Limits and Overloads Should be Treated Like This!

In order to standardize the special actions for over-limit and overload control, the Ministry of Communications and the Ministry of Public Security recently jointly issued the “Notice on Regulating the Law Enforcement of the Special Action for Over-limit and Overload Control.” The notice gave detailed instructions on the standardized operation of joint law enforcement and highlighted key points.

The focus of the document is:

1. Centrally investigate and punish the violations of the total mass of freight vehicles with three axles and above that exceed the load limit standard to ensure the effect of rectification;

2. The determination of over-limit and overload shall be determined in strict accordance with the maximum allowable total mass of highway trucks attached to Document No. 109, Jiao Gong Lu (2016), to determine whether the truck is overloaded or overloaded;

3. Calculate the overload ratio based on the maximum allowable total mass of trucks, and the public security traffic management department shall punish them in accordance with the relevant provisions of the Road Traffic Safety Law;

4. If the size of the outer profile exceeds the limited standard, additional rectification will be deployed.

Policies for five types of vehicle models are loosened:

During the implementation of the new national standards, plans, and new regulations, there were a lot of complaints from truck drivers, and the main opinions were focused on the load and size of the models. The gospel brought by this notice, especially for the following five special vehicles, the notice puts forward specific implementation requirements during the special operation:

1. For hazardous chemicals transport vehicles:

If a dangerous chemical transport vehicle violates the law and exceeds the limit and overload, the public security organ shall impose penalties in accordance with the relevant provisions of Article 88 of the “Regulations on the Safety Management of Hazardous Chemicals.”

2. For fresh agricultural products transport vehicles:

If vehicles transporting fresh agricultural products illegally exceed the limit and overload, when passing toll roads, the preferential policy of waiving vehicle tolls shall not be granted for that transportation; when passing non-toll roads, criticism and education shall be the main objective, and no penalty shall be imposed for the time being.

3. For container trailer trains:

For trailer trains carrying standard containers, the focus is on the behavior of checking whether the total mass of the trucks and cargo exceeds the load limit standard. During the special operation, the outer profile dimensions will not be checked temporarily.

4. For vehicle transport vehicles:

The management of vehicle transport vehicles must be strictly implemented in the “General Office of the Ministry of Transport, the General Office of the National Development and Reform Commission, the General Office of the Ministry of Industry and Information Technology, the General Office of the Ministry of Public Security, and the General Office of the General Administration of Quality Supervision,

In this regard, it is not difficult to see that in the face of the voices of the people, the two departments have heard and absorbed every one’s opinions. I believe that drivers and companies will suddenly feel “relaxed”, and this is indeed a certain degree of policy loosening. The analysis believes that the focus at this stage is overload management, and the specific implementation of regulations related to vehicle size and other over-limits still awaits follow-up details.

The administrative department shall impose penalties in accordance with the relevant provisions of the Road Traffic Safety Law.

This means that the law enforcement agencies have changed from “comprehensive governance” to “centralized governance”, which is more targeted, that is, “limit overload.”
