On August 22, 2022, the Brazilian Foreign Trade Secretariat issued Announcement No. 38 of 2022 in the Official Gazette of the Federal Government, stating that in response to the application submitted by the Brazilian domestic company Vallourec&Mannesmann Tubes do Brasil S.A. and Romania’s seamless carbon steel pipe (Portuguese: tubosde aço carbono, sem costura, de condução (line pipe)) initiated an anti-dumping sunset review investigation.
The products involved are seamless carbon steel pipes (line pipes) not exceeding 5 inches (141.3 mm) in diameter for oil and gas pipelines, involving MERCOSUR tax numbers 7304.19.00, 7304.31.90, 7304.39.10, and 7304.39.90 products under the item. The dumping investigation period, in this case, is from January 2021 to December 2021, and the damage investigation period is from January 2017 to December 2021. The announcement takes effect from the date of publication.
On October 19, 1998, Brazil initiated an anti-dumping investigation on seamless carbon steel pipes originating in Romania in response to the application submitted by Vallourec & MannesmannTubes do Brasil S.A., a Brazilian domestic company, on May 13, 1998. On October 20, 1999, Brazil made a final anti-dumping ruling on the case and decided to impose a 5-year anti-dumping duty of 32.2% on the Romanian products involved in the case, valid until October 20, 2004.
Subsequently, Brazil initiated three anti-dumping sunset review investigations on seamless carbon steel pipes originating in Romania and made positive final rulings on October 7, 2005, August 10, 2011, and August 22, 2017, respectively. Maintain the 14.3% anti-dumping duty unchanged, and extend the validity of the levy for the third time until August 22, 2022.
On December 21, 2010, the Brazilian Foreign Trade Secretariat issued Announcement No. 59, in response to the application submitted by the Brazilian domestic company VallourecTubos do Brasil S.A. on October 20, 2010, to initiate an anti-dumping investigation on seamless carbon steel pipes originating in China. On September 8, 2011, the Brazilian Foreign Trade Commission (CAMEX) issued Resolution No. 63, making an affirmative final ruling on the case, deciding to impose a five-year anti-dumping duty on the Chinese products involved in the case, with a tax amount of US$743.00/ton, valid until 2016 September 8th.
On September 8, 2016, the Brazilian Foreign Trade Secretariat issued Announcement No. 55, in response to the application submitted by Vallourec Tubos do Brasil S.A., a Brazilian domestic enterprise on April 29, 2016, to initiate the first batch of seamless carbon steel pipes originating in China. The second anti-dumping sunset review investigation. On August 22, 2017, the Brazilian Foreign Trade Commission issued Resolution No. 66, which decided to continue to impose a five-year anti-dumping duty of US$743.00 per ton on the Chinese seamless carbon steel pipe sunset review, which is valid until August 22, 2022. The MERCOSUR tax number of the product involved is 7304.19.00.
